Niche construction refers to the activities of organisms that bring about changes in their environments, many of which are evolutionarily and ecologically consequential. Advocates of niche construction theory (NCT) believe that standard evolutionary theory fails to recognize the full importance of niche construction, and consequently propose a novel view of evolution, in which niche construction and its legacy over time (ecological inheritance) are described as evolutionary processes, equivalent in importance to natural selection. Here, we subject NCT to critical evaluation, in (...) the form of a collaboration between one prominent advocate of NCT, and a team of skeptics. We discuss whether niche construction is an evolutionary process, whether NCT obscures or clarifies how natural selection leads to organismal adaptation, and whether niche construction and natural selection are of equivalent explanatory importance. We also consider whether the literature that promotes NCT overstates the significance of niche construction, whether it is internally coherent, and whether it accurately portrays standard evolutionary theory. Our disagreements reflect a wider dispute within evolutionary theory over whether the neo-Darwinian synthesis is in need of reformulation, as well as different usages of some key terms (e.g., evolutionary process). Although previous ethical analyses of management buyouts have presented useful insights, they have been flawed in three major ways. First, they define the transaction too narrowly, emphasizing the going private aspect and ignoring the leveraged aspect. Leveraging alters the nature of the transaction substantially and warrants additional ethical analysis. Second, these previous analyses ignore the impact of buyouts on non-stockholder constituents of the firm, an omission which renders their implicit utilitarian approach incomplete. Third, these analyses do not include Rawlsian, libertarian, (...) or Kantian perspectives on ethics. This paper addresses these shortcomings and finds the ethical status of leveraged management buyouts to be highly suspect. (shrink)

Mike Almeida recently published a paper entitled “Evil Is Not Evidence,” but that title rather understates his conclusion. He argues that no “states of affairs constitute any (non-trivial) evidence for or against the existence of God” (p. 1, original emphasis) (bare page references are to Almeida, 2022). It of course follows from that that evil is not evidence against the existence of God, but it also follows that apparent design or even direct experience of God are not non-trivial evidence for (...) the existence of God. While his title suggests a conclusion favorable to theists, it might in fact be a poisoned pawn, since his conclusion also entails that arguments from design or religious experience are completely hopeless. Such a radical transformation of the traditional debate between theists and atheists bears scrutinizing. In particular, Almeida appeals to a notion of evidence that I'm going to argue is mistaken. The basic argument I am going to make is that Almeida is taking strict implication to be an evidentially relevant relation. In particular he's embracing one of the paradoxes of strict implication, that a necessary truth is strictly implied by any claim whatever, and he's assuming that not only is the inference valid, pace relevance logics, but that it provides evidence for the implied proposition. I'm going to argue this is a mistake. Even if we grant that the inference is valid, we shouldn't accept that it provides evidence. (shrink)

Free will is often said—by compatibilists and incompatibilists alike—to be a power (or complex of powers) of agents. This paper offers proposals for, and examines the prospects of, a powers-conception of free will that takes the powers in question to be causal dispositions. A difficulty for such an account stems from the idea that when one exercises free will, it is up to oneself whether one wills to do this or that. The paper also briefly considers whether a powers-conception that (...) invokes powers of a different kind, such as agent-causal or noncausal powers, might fare better with respect to this problem. A new approach to introducing theology As God's self-communication to humans, Jesus is the key to the human search for meaning, argues Thomas West. He therefore introduces the practice of theology through Christology. From the question of personal meaning and self-constitution and their relationship to transcendent meaning and value, he proceeds to discuss the figure and import of Jesus and then the ethical imperative engendered through encounter with him. Fresh and clear, West's book is an invitation to (...) grapple with one's religious commitments, especially in light of recent insights in biblical studies and Continental, feminist, and liberation theologies. The work of the German Marxist philosopher Ernst Bloch (1885-1977) is often referred to by theologians and philosophers of religion, but its enormous scope and complexity have made access to it difficult, especially for the English-speaking reader. Undergirded as it is by an ontology of hope, there is a pervasive tension in Bloch's work that moves it in contradictory directions. This tension also manifests itself in his politics, which alternate between an uncritical support of Stalinism and an almost otherworldly detachment (...) from any concrete socialist program. Bloch's life and work, with a focus on his political allegiances, are thoroughly introduced in this book. Also, it offers a close reading of his greatest work, The Principle of Hope, an analysis of his philosophy of biblical religion, and a critical examination of his ontology of hope. Conversant with the latest scholarship and attentive to the needs of those who do not have easy access to the foreign language sources, this book is an ideal introduction to the work of Bloch, especially for those interested in his treatment of religion. It is widely believed that there is more freedom of speech in America today than there was at the time of the founding. Indeed, this view is shared by liberal commentators, as one would expect, as well as by leading conservatives, which is more surprising. “The body of law presently defining First Amendment liberties,” writes liberal law professor Archibald Cox, grew out of a “continual expansion of individual freedom of expression.” Conservative constitutional scholar Walter Berns agrees: “Legally we enjoy a (...) greater liberty [of speech] than ever before in our history.” This shared assessment is correct—from the point of view of the political theory of today's liberalism—but it is incorrect from the point of view of the political theory of the American founding. Reed combines extensive archival research; analysis of art, architecture, and literature; the insights of queer theory; and an appreciation of irony to explore the East-West (...) encounter through three revealing artistic milieus: the Goncourt brothers and other japonistes of late-nineteenth-century Paris; collectors and curators in turn-of-the-century Boston; and the mid-twentieth-century circles of artists associated with Seattle's Mark Tobey. The result is a groundbreaking integration of well-known and forgotten episodes and personalities that illuminates how Japanese aesthetics were used to challenge Western gender conventions. These disruptive effects are sustained in Reed's analysis, which undermines conventional scholarly investments in the heroism of avant-garde accomplishment and ideals of cultural authenticity. T.J. Reed's study has long established itself as the standard work in English on Thomas mann, and offers as comprehensive a view of Mann's fiction and thought as is available in any language. It is based on a coherent close reading of Mann's oeuvre, literary and political, and also on manuscripts and sources, and was part of the first phase of literary scholarship that opened up the resources of the Zurich Thomas Mann Archive. Further documents that have (...) appeared since then - Mann's diaries, notebooks, and other correspondences - have not fundamentally altered the individual interpretations or the overall picture the study offers, and in some respects have emphatically confirmed them. A further chapter added to this edition covers the new documentation, gives a vigorous account of the main curents in Mann scholarship and criticism over the last two decades suggesting how we should now see the writer, the man, and the political figure, and above all the complex relationship between the three. I am the LawIt is hard to imagine two more disparate characters than Judge Joseph Dredd and Hercules J—the one an over-muscular, faceless and heavily armed street judge astride a Lawmaster motorcycle who overidentifies with his role ; the other devoid of any physical presence or image, and structurally decoupled from the execution of law by a fierce determination to maintain the separation of powers and accountability which Dredd so effortlessly ignores. Hercules J is the embodiment of an intellectualised, yet (...) creative, operationalisation of law. To the academic spirit, Hercules is infinitely preferable as a model of judicial activism: his world conjures a contemplative modality, ever alert to the requirements of rights and largely aligned with the temper of the post-Enlightenment. By contrast, Dredd is the personification of the worst aspects of law-and-order as the debased and politicised manifestation of the Rule of Law. His is an intensely visceral presence, the metonymic blindness of Themis replaced by the Dredd’s fractured eyeline: blindness as a signifier of impartiality yields to blindness as a symptom of institutional rage. This article interrogates the characters, actions and values of Hercules J and Dredd J, viewed primarily through the lens of Jacques Derrida’s Force of Law, focusing on the relationship between law and violence as it is exposed in Hercules’s and Dredd’s worlds, and then turning to judicial confrontation with the aporetic: the aporias, identified by Derrida and others, that law must confront. The interrogation continues, finally contemplating the current state of law in the common law world—the world of liberal democracies, suggesting that the high point of democracy may well have passed, and that we are on a Dredd-ward trajectory. There are four main claims to the book associated with these four parts, each of which is divided into sub-themes. Thus, one can denote a number of inevitably controversial ideas advanced (...) by the book. In clarifying the nature of these claims, I can initially respond to some of the main points advanced by various of the helpful review essays in this symposium.Framing the Argument of the BookThe first part of the work posits that there is a fundamental developmental continuity between Old and New Testament revelation, wherein God is revealed first to Israel as the one Creator, and subsequently in Jesus Christ as three distinct persons, the eternal Father, Son, and Holy Spirit.1 This revelation is in turn received in the pre-Nicene era of the early Church, principally under a twofold conceptual format, according firstly to a model of God as a single transcendent subject of wisdom who sends his Word into the world in human nature, and inspires the prophets by his Spirit (the apologists' monotheistic model, exemplified by Justin Martyr) and, secondly, to [End Page 569] a model of economic Trinitarian activity, of the Father, Son and Spirit, who are each divine and one in being, active in sacred history (Irenaeus).2 Nicene Trinitarian authors sought in various ways to find a deeper concordance of the two approaches, one of which emphasized more the immanent unity of God (potentially tending toward a danger of Sabellianism) and the other of which emphasized real distinction of persons active in the economy (potentially tending toward the danger of subordinationism).3 Pro-Nicene figures like Athanasius, Gregory of Nazianzus, and Augustine, among others, paved the way for a mature doctrine of immanent Trinitarian life, in which God was understood to be characterized, mysteriously, by eternal processions of the Word and the Spirit who originate from the Father, and receive from him the plenitude of their deity or divine nature, and thus are equally and identically the one God.4 God is mysteriously three persons who are truly one both in essence and being.The second part of the book is concerned with the theological exploration of what it means to speak of God as one, and of the divine nature of God. This determination of Christian theological wisdom stems from a threefold exigency: first, to uncover the inner unity of revelation itself, as indeed the Israelite revelation of the divine unity and the oneness of God the transcendent Creator is thematic to both Testaments;5 second, to consider the preconditions of Nicene orthodoxy, as indeed the claim that the three persons in God are one in essence or nature presupposes that there is a nature of God that is one common to the three persons;6 third, to consider what must be said about the inner life of God as truth and love, as a precondition for thinking about the processional life of the Word and Spirit, who are immanent distinct persons in God who receive and possess this fullness of life but who do not divide this one eternal life in God or cause it to evolve due to their relational proceeding.7I argue that a consideration of God's nature as simple, perfect, good, eternal, immutable, and so forth is essential to any theology that takes the biblical revelation of the unity and transcendence of God seriously, and therefore confesses the revelation of the Trinity integrally.8 Furthermore, regarding [End Page 570] the apophatic contours of this form of reflection, I hold that it is precisely in order to guarantee the kind of circumspect avoidance of "non-biblical speculation" about positive knowledge of God outside of Christ that it is necessary to qualify rightly how God is not identifiable with creation and thus remains unknown in his inner divine nature and eternal life apart from and outside of his divine self-disclosure in the revelation of the Old and New Testaments.
